Abacus Contract Management Definitions"NAE" means the Navy Acquisition Executive. ASN(RD&A) is the NAE. "NAF" means a non-appropriated fund. Non-appropriated fund instrumentalities typically include Officers Clubs, recreation facilities, etc. "NAFTA." See U.S. Customs web site - North American Free Trade Agreement. "NAFTA country end product" means an article that- "NAICS" or the North American Industry Classification System has replaced the U.S. Standard Industrial Classification (SIC) system. NAICS was developed jointly by the U.S., Canada, and Mexico to provide new comparability in statistics about business activity across North America. Size standards and other programs in the Federal Acquisition Regulation are based on NAICS. (FAC 2001-02, Dec 18, 2001) "National defense" means any activity related to programs for
military or atomic energy production or construction, military assistance to any
foreign nation, stockpiling, or space. "National Defense Projects Rating Plan," also known as the Special Casualty Insurance Rating Plan, is a risk-pooling arrangement to
minimize the cost to the Government of purchasing the liability insurance listed in FAR
28.307-2. "National emergency" means a condition declared by the President or the Congress which authorizes certain emergency action in the national interest, including partial or total mobilization of national resources. "National security system" means any telecommunications or information system operated by the United States Government, the function,
operation, or use of which-- "NATO cooperative projects." See "Cooperative project." "NAVAIRSYSCOM" means the Naval Air Systems Command. "Naval Shipyards" serve naval forces under the cognizance of the Naval Sea Systems Command. "NAVFACENGCOM" means the Naval Facilities Engineering Command. "NAVSEASYSCOM" means the Naval Sea Systems Command. "NAVSUPSYSCOM" means the Naval Supply Systems Command. "Navy" or "DoN" means the Department of Navy
including the Marine Corps, unless otherwise specified. "Navy Clause Baseline" means all approved Navy standard component clauses. "NCAGE code." See "Commercial and Government Entity (CAGE) code." "NECO" means Navy Electronic Commerce Online, an implementation of the Navy's strategy to convert to paperless processes. "NECO Registered Buyers" are authorized to upload solicitations and supporting documents to NECO for vendor download. To gain access to the Buyer Upload site, you must be a NECO Registered Buyer. Your command point-of-contact for NECO is authorized to register buyers. NECO requires the following information to register a buyer: name, telephone, fax, email, and UIC. Once registered, NECO will forward an email to the buyer providing web site location, email address, and password, "Negative instant contract savings" means the increase in the instant contract cost or price when the acceptance of a VECP results in an
excess of the contractor's allowable development and implementation costs over
the product of the instant unit cost reduction multiplied by the number of
instant contract units affected. "Negotiated contract" ... This part prescribes policies and
procedures governing competitive and noncompetitive negotiated acquisitions. A
contract awarded using other than sealed bidding procedures is a negotiated contract (see 14.101). "Negotiation" is a process by which disputants communicate their differences to one another through conference, discussion and compromise, in order to resolve them. "Net acquisition savings" means total acquisition savings, including instant, concurrent, and future contract savings, less Government costs. "Network analysis system" means recognized scheduling systems that show the duration, sequential relationship, and interdependence of various
work activities, e.g., critical path method. "Neutral person" means an impartial third party, who serves as a
mediator, fact finder, or arbitrator, or otherwise functions to assist the
parties to resolve the issues in controversy. A neutral person may be a
permanent or temporary officer or employee of the Federal Government or any
other individual who is acceptable to the parties. A neutral person must have
no official, financial, or personal conflict of interest with respect to the
issues in controversy, unless the interest is fully disclosed in writing to all
parties and all parties agree that the neutral person may serve (5 U.S.C.
583). "New" means composed of previously unused components, whether
manufactured from virgin material, recovered material in the form of raw
material, or materials and by-products generated from, and reused within, an
original manufacturing process; provided that the supplies meet contract
requirements, including but not limited to, performance, reliability, and life
expectancy. "NMCI" or Navy Marine Corps Intranet is intended to develop a long-term arrangement with the commercial sector which transfers the responsibility and risk for providing and managing the vast majority of Department of Navy desktop, server, infrastructure, and communication assets and services. The contract for NMCI was awarded to Electronic Data Systems in Oct 2000. "No-setoff commitment," as used in this subpart, means a
contractual undertaking that, to the extent permitted by the Act, payments by
the designated agency to the assignee under an assignment of claims will not be
reduced to liquidate the indebtedness of the contractor to the Government. "Nonappropriated-fund instrumentality." See "NAF." "Noncommercial computer software" means software that does not qualify as commercial computer software under paragraph (a)(1) of this clause. "Noncommon carrier" means any entity other than a common carrier offering telecommunications facilities, services, or equipment for lease. "Nonconformance." See "Major nonconformance," "Minor nonconformance," or "Critical nonconformance." "Nonconforming markings". Authorized markings are identified in the clause at 252.227-7013, Rights in Technical Data--Noncommercial Items. All
other markings are nonconforming markings. An authorized marking that is not in
the form, or differs in substance, from the marking requirements in the clause
at 252.227-7013is also a nonconforming marking. "Nondesignated country end product" means any end product that is not a U.S. made end product or a designated country end product. "Nondesignated country end product" means any end product which
is not a U.S. made end product or a designated country end product. "Nondevelopmental item" means-- "Noneligible offer" means an offer of a noneligible product. "Noneligible product" means a foreign end product that is not an eligible product. "Nonindependent regulatory body" means a body that regulates a utility supplier which is owned or operated by the same entity that created the
regulatory body, e.g., a municipal utility. "Nonmanufacturer rule" means that a contractor under a small business set-aside or 8(a) contract shall be a small business under the
applicable size standard and shall provide either its own product or that of
another domestic small business manufacturing or processing concern (see 13 CFR 121.406). "Nonpersonal services contract" means a contract under which the personnel rendering the services are not subject, either by the contract's terms
or by the manner of its administration, to the supervision and control usually
prevailing in relationships between the Government and its employees. "Nonprocurement Common Rule" means the procedures used by Federal Executive Agencies to suspend, debar, or exclude individuals or entities from
participation in nonprocurement transactions under Executive Order 12549. Examples of nonprocurement transactions are grants, cooperative agreements, scholarships, fellowships, contracts of assistance, loans, loan guarantees, subsidies, insurance, payments for specified use, and donation agreements. "Nonprofit agency serving people who are blind" or "nonprofit
agency serving people with other severe disabilities" (referred to jointly as JWOD participating nonprofit
agencies) means a qualified nonprofit agency employing people who are blind
or have other severe disabilities approved by the Committee to furnish a
commodity or a service to the Government under the Act. "Nonprofit organization" means any organization described by Section
501(c)(3) of Title 26 of the U.S.C. which is exempt from taxation under
Section 501(a) of Title 26. "Nonprofit organization" means a university or other institution of higher education or an organization of the type described in section 501(c)(3) of the Internal Revenue Code of 1954 (26 U.S.C. 501(c)) and exempt from taxation under section 501(a) of the Internal Revenue Code (26 U.S.C. 501(a)), or any nonprofit scientific or educational organization qualified under a State nonprofit organization statute. "Nonprofit organization," as used in this subpart, means any corporation, foundation, trust, or institution operated for scientific,
educational, or medical purposes, not organized for profit, and no part of the
net earnings of which inures to the benefit of any private shareholder or
individual. "Nonqualified pension plan" means any pension plan other than a qualified pension plan as defined in this part. "Nonqualifying country" means a country other than the United States or a qualifying country. "Nonqualifying country end product" means an end product that is neither a domestic end product nor a qualifying country end product. "Nonqualifying country offer" means an offer of a nonqualifying country end product, including the price of transportation to destination. "Nonrecurring costs" means those costs which are generally
incurred on a one-time basis and include such costs as plant or equipment relocation, plant rearrangement, special tooling and special test equipment, preproduction engineering, initial spoilage and rework, and specialized work force training. "Nonseverable," as used in this subpart, when related to
Government production and research property, means property that cannot be
removed after erection or installation without substantial loss of value or
damage to the property or to the premises where installed. "Nonseverable deliverable," as used in this subpart, means a deliverable item that is a single end product or undertaking, entire in nature, that cannot be feasibly subdivided into discrete elements or phases without losing its identity. DFARS 204.7101 Uniform Contract Line Item Numbering System "Nonsponsor" means any other organization, in or outside of the Federal Government, which funds specific work to be performed by the FFRDC and is not a party to the sponsoring agreement. "Non-standard Component Clause" means a component clause not prescribed for use in a component regulation. "Norfolk Naval Shipyard" is one of four naval shipyards supporting naval forces under the cognizance of the Naval Sea Systems Command. "Normal cost" means the annual cost attributable, under the
actuarial cost method in use, to current and future years as of a particular
valuation date excluding any payment in respect of an unfunded actuarial
liability. "Normal workweek," as used in this subpart, means, generally, a workweek of 40 hours. Outside the United States, its possessions, and Puerto
Rico, a workweek longer than 40 hours shall be considered normal if-- "North American Free Trade Agreement (NAFTA) country" means Canada or Mexico. "North American Free Trade Agreement country end product" means an article that-- "Notice" means Standard Form (SF) 98, "Notice of Intention to Make a Service Contract and Response to Notice," and SF 98a, "Attachment A." The term "Notice" is always capitalized in this subpart when it means Standard Forms 98 and 98a. "Notice of proposed rule making" is a required public notice in the Federal Register of a proposed rule, pertaining to the Federal Acquisition Regulation, Defense Federal Acquisition Regulation Supplement, or other codified documents, permitting public comment for a period of time before implementing the new rule. See the Regulatory Flexibility Act at "Laws That Affect Federal Register Publication." "Notice to proceed" is a document used in contract administration that normally includes a statement of work, the key schedule milestones for task
accomplishment, and the total amount of funds allotted to the tasks. Upon receipt of the notice to proceed, the supplier will begin work and start cost and scheduling reporting for the tasks concerned. "Novation agreement" means a legal instrument-- "NPRM." See "Notice of Proposed Rule Making." "NSPE" means Navy Senior Procurement Executive. ASN(RD&A) is the NSPE. "Number of employees" is a measure of the average employment of a business concern and means its average employment, including the employees of its domestic and foreign affiliates, based on the number of persons employed on a full-time, part-time, temporary, or other basis during each of the pay periods of the preceding 12 months. If a business has not been in existence for 12 months, "number of employees" means the average employment of such concern and its affiliates during the period that such concern has been in existence based on the number of persons employed during each of the pay periods of the period that such concern has been in business. If a business has acquired an affiliate during the applicable 12-month period, it is necessary, in computing the
applicant's number of employees, to include the affiliate's number of employees during the entire period, rather than only its employees during the period in which it has been an affiliate. The employees of a former affiliate are not included, even if such concern had been an affiliate during a portion of the
